These Terms of Service (“Terms”) govern your use of the Sidepilot platform and services (“Services”).
By using our Services, you agree to these Terms.
Sidepilot is an AI-powered client engagement platform that automates lead follow-up, appointment booking, and member communication for gyms, studios, wellness centers, salons, and spas.
Our Services operate through SMS, email, voice, and other communication channels.
To use Sidepilot, you must:
You are responsible for all activity under your account.
Your subscription includes a monthly messaging credit allowance.
This covers outbound messages and communication time (SMS, email, and voice minutes).
If you exceed this allowance, overage charges will apply.
Overage Rate: $0.003 or more per message or minute, depending on volume and carrier costs
Twilio Charges: Our system relies on Twilio.
Carrier surcharges and Twilio fees may be passed through.
We reserve the right to update pricing with notice.
All usage is subject to our fair use policy.
By using Sidepilot, you agree to comply with all applicable communication laws, including the TCPA and CAN-SPAM Act.
You are responsible for ensuring you have obtained appropriate consent from all contacts before sending messages.
Customers must obtain explicit consent from leads and clients before messaging them through Sidepilot.
Recipients can opt out at any time by replying STOP to SMS messages or by contacting support@sidepilot.com.
Users must comply with all applicable messaging regulations.
Violation of these policies may result in suspension or termination.
By providing your mobile number, you agree that Sidepilot and its customers may send you periodic SMS or MMS messages containing but not limited to important information, updates, deals, and specials.
You will receive up to 50 messages per month.
You may unsubscribe at any time by texting the word STOP to the number from which you receive messages.
You may receive a subsequent message confirming your opt-out request.
For help, reply to any message with the word HELP.
Message and data rates may apply.
U.S. Participating Carriers include AT&T, T-Mobile®, Verizon Wireless, Sprint, Boost, U.S. Cellular®, MetroPCS®, InterOp, Cellcom, C Spire Wireless, Cricket, Virgin Mobile, and others.
T-Mobile is not liable for delayed or undelivered messages.
You agree to notify us of any changes to your mobile number and update your account to reflect this change.
Data obtained from you in connection with this SMS service may include your cell phone number, your carrier’s name, and the date, time, and content of your messages, as well as other information that you provide.
We may use this information to contact you and to provide the services you request from us.
By subscribing or otherwise using the service, you acknowledge and agree that we may change or terminate the service at any time, with or without cause or advance notice.
Though Sidepilot and its customers will never charge you for text messages, depending on your phone plan, you may see some charges from your mobile provider.
All fees are non-refundable unless otherwise required by law.
You retain ownership of all customer data submitted to Sidepilot.
We process data on your behalf in accordance with our Privacy Policy.
You agree not to use Sidepilot to:

Sidepilot integrates with third-party providers like Twilio, Stripe, Meta, and Google.
You acknowledge and agree that:
Sidepilot is provided “as is” and “as available.”
We do not guarantee specific results, uptime, or that the Services will be error-free.
To the fullest extent permitted by law, Sidepilot will not be liable for any indirect, incidental, or consequential damages, including lost profits or business interruption.
Our total liability for any claims related to the Services will not exceed the amount paid by you for the Services in the 12 months preceding the claim.
You may cancel your subscription at any time by providing 30 days’ written notice to support@sidepilot.com.
We may suspend or terminate your access if you violate these Terms or if your account becomes delinquent.
We may update these Terms at any time.
We’ll notify you via email or in-app notification when significant changes are made.
Continued use of the Services means you accept the updated Terms.
These Terms are governed by the laws of the State of Delaware, without regard to its conflict of law principles.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Sidepilot regarding the use of our Services.
They supersede any prior agreements, understandings, or representations.
